Terms of Service

These are the terms between you and Evra, who operates LaunchEvra. They apply when you create an account, ask us for a quote, or have a website built. They are written to be read — if any of it is unclear, ask us before you agree to it.
1. Who you are agreeing with
LaunchEvra is a service operated by Evra. In these terms "we" and "us" mean Evra, and "you" means the person or business using the service.
You agree to these terms by creating an account, by submitting a brief, or by accepting a quote — whichever happens first. If you are agreeing on behalf of a company, you are confirming you are allowed to.
2. Your account
One Evra account works across every Evra product. If you already use one of them, this is the same account and the same password.
Keep your sign-in details to yourself. Anything done from your account is treated as done by you, so tell us straight away if you think someone else has access to it.
Having a website built does not give you a subscription to any other Evra product, and a subscription to one of them does not include a website. They are priced separately and neither is a tier of the other.
3. What we build
We design, write and build a website from what you tell us in the intake form, then put it online. The brief you submit is what we work from, so the more accurate it is, the closer the first version lands.
The pages, the features and the number of rounds of changes during the build are the ones listed for the tier you accepted. Anything outside that is new work, and we will quote it before starting rather than absorb it quietly or bill you for it afterwards.
Nothing goes live until you have seen a private preview and said yes.
4. Quotes and prices
The prices on our pricing page are what projects actually land at, in US dollars. Your figure follows your brief, and we confirm it with you before any work starts.
A quote covers the work described in it. If what you need changes after you accept — more pages, a feature that was not in the brief, a redesign after approval — we will tell you what that costs before doing it.
5. Paying for the build
The build fee is paid in two halves: half when you accept the quote, and half when you approve the finished site. We invoice through Stripe and start work once the first invoice clears.
Invoices are due on receipt. If one goes unpaid we will chase it before doing anything else, but we may pause work on a project whose invoice is overdue.
6. The care plan
Every site we build carries a care plan. It is not optional, and it is not a support add-on: it is what keeps the site online. Hosting, the certificate, your domain staying pointed at the site and your contact form working are costs that recur every month for as long as the site is up, and the monthly is what covers them. The included changes come on top of that.
The plan is paid by card, monthly or yearly, and you start it yourself from your project page. Yearly is 12 months at the same monthly price, charged once — a convenience for people who would rather deal with one payment a year, not a discount.
It renews automatically until you cancel it. You can cancel at any time from your project page, and it then runs to the end of the period you have already paid for.
7. Changes after your site is live
Your plan includes a set amount of change time each month — the amount is listed on the pricing page for your tier. Text, photos, prices and opening hours are exactly what it is for: you ask, and it gets done, with no quote and no invoice each time.
Unused time does not roll over. Anything beyond the included time is quoted before we start, at $95 per hour with a 30-minute minimum. You will never be billed for change work you did not agree to first.
8. If the plan stops
This is the part to read twice. The monthly is what pays for hosting, so if the plan stops we stop hosting the site and it comes down.
We will always tell you before that happens — a site does not vanish quietly. And we will not hold it hostage either: we send you the finished files so you can host them wherever you like, and your domain stays yours because it was always registered in your name.
The same applies if a payment fails and is not resolved after we have contacted you about it.
9. Your domain
Your domain is registered in your name, on your card. We will help you set it up and point it at the site, and we never ask for your registrar login.
That means it stays yours whatever happens between us, including if you stop working with us.
10. What you send us
You keep ownership of the text, images, logos and anything else you give us. By sending them you confirm you own them or have permission to use them, and you let us use them for the purpose of building and running your site.
We can refuse or remove content that is unlawful, that infringes someone else's rights, or that we are not willing to publish. If that happens we will tell you why.
11. Who owns the finished site
Once the build fee is paid in full, the design, the pages and the content of your site are yours. You can take the files and host them elsewhere, and we will send them to you if you ask.
What stays ours is the general tooling behind it — the templates, components and internal code we reuse across projects. You are not buying that, and nothing here stops us building something similar for someone else.
12. What we do not promise
We build a site that works properly and reads well. We do not promise search rankings, traffic, enquiries or sales — nobody can, and anyone who does is selling you something.
Some parts of a site depend on services we do not control: payment processing, booking, maps, analytics, your email provider. Those have their own terms and their own outages.
We do our best to keep sites up, but we do not offer a guaranteed uptime figure, and occasional maintenance is part of running a site.
13. Refunds
The first half of the build fee pays for work that starts as soon as it clears, so it is not refundable once we have begun. If you cancel before we start, we refund it.
The care plan can be cancelled at any time and runs to the end of the period you paid for. We do not refund part of a month or part of a year.
None of this removes any right you have under consumer protection law that cannot be waived by agreement.
14. Ending it
You can stop at any time: cancel the care plan from your project page, and tell us if you want the files.
We can end it too — for an unpaid invoice we have chased, for content we are not willing to host, or for behaviour towards us that makes the work untenable. We will tell you first and, where the build fee has been paid, we will send you the files.
15. Liability
If something goes wrong and we are responsible, what you can recover from us is limited to what you have paid us in the twelve months before it happened.
We are not liable for indirect losses — lost profit, lost business, lost data on services we do not run.
Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
16. Changes to these terms
We may update these terms. The date at the top of this page always says when they last changed.
If a change materially affects a plan you are paying for, we will email you before it takes effect so you can decide whether to continue.
17. Governing law
These terms are governed by the Province of Quebec and the federal laws of Canada applicable therein, and the courts there have jurisdiction over any dispute arising from them.
